Robert Bucksath

Robert was admitted to legal practice in 2014 and practises exclusively in criminal law, with over a decade of experience across both prosecution and defence. His career includes six years as a prosecutor with the Office of the Director of Public Prosecutions NSW (ODPP) and extensive time acting as a criminal defence lawyer both before and after that role.

He is a pragmatic and highly dedicated advocate who works relentlessly to protect his clients’ interests. Robert takes the time to properly understand each client’s circumstances and provides clear, direct and honest advice at every stage of the process. His approach is grounded, strategic, and focused on outcomes, not theatrics.

Robert has significant advocacy experience appearing in criminal courts across New South Wales, including the Local, District and Supreme Courts. He has worked across the full spectrum of criminal matters, from traffic and summary offences through to serious indictable matters, including homicide. His early experience in Community Legal Centres exposed him to some of the most confronting matters in the system and regularly took him to regional and circuit courts, while his later work has seen him operate extensively in metropolitan and superior courts.

This combination has made him highly adaptable, equally comfortable dealing with the vastly different styles, expectations and pressures of courts at every level.

More recently, Robert spent six years working at the highest level of prosecution with the ODPP. That experience gave him a rare and valuable insight into how matters are assessed, prepared and run from the other side. It is this understanding of the internal processes, decision-making and strategic mindset of prosecutors that now allows him to anticipate and dismantle the Crown case with precision.

Unlike many defence lawyers, Robert has seen matters from both sides at a serious level, including cases that rarely make their way into private defence practice. This breadth of exposure has shaped him into a formidable opponent for Police and prosecutors alike.

Importantly, Robert started his career in defence, building a strong foundation before moving into prosecution and then deliberately returning to defence with that enhanced perspective. He has extensive experience in complex and technical matters involving strict evidentiary and procedural requirements, and is particularly drawn to challenging and nuanced cases.

He regularly appears in court for bail applications, sentence proceedings (including non-conviction applications), mental health diversion matters, defended hearings and jury trials. He works closely with a select group of leading barristers, but is equally comfortable running matters himself where appropriate.
