Sometimes, innocent people get accused of committing crimes. Unfortunately, those who have committed one crime are often accused of committing additional, more serious crimes (sometimes wrongfully).

Generally speaking, yes. Not knowing the law is not a defence when it comes to a crime. It is difficult to use this as a defence in good faith when, in most cases, the crime tends to be obviously illegal.

We understand that criminal charges are stressful and you want the experience to be over as soon as possible. However, there is no hard and fast rule regarding the length of a trial. It all depends on the complexity of the case and the seriousness of the crime that has been committed. A simple misdemeanour could be resolved in a few weeks, whereas a criminal case might last for several months or years.

If the prosecution makes a reasonable plea offer early in the process, the case will end sooner than if it goes to trial.

If this occurs, we recommend discussing the plea bargain with your lawyer before making any decisions. We will guide you on the right path.

In a criminal context, negligence is a state of mind that is equated to recklessness. Both negligence and recklessness arise when the defendant disregards the possibility or substantial risk of harm.

Possibly. You can use this defence if you have a reasonable belief that you were defending yourself or someone else who was in imminent danger. If you started the fight, you could potentially use self-defence if you used preventative force in a situation where you believed someone was about to use force against you. However, self-defence is limited to what would be necessary to prevent an attack.

If you have been suspected of a criminal offence or you are being spoken to by police, we strongly recommend contacting a lawyer before saying a word.

The police must tell you that you do not have to say anything but anything you do say may be used against you in Court. They are also obliged to tell you that you may speak to a lawyer.

If the police interview you about an offence (excluding traffic offences), they have the right to take your fingerprints and can use reasonable force to take them if you refuse. If there are no charges are laid against you, the police are obliged to destroy them within six months.

Police, however, cannot make you give a forensic sample (e.g. blood or saliva) without an order from a Magistrate. A senior police officer can authorise a non-intimate compulsory procedure for people held in jail, a police cell or a secure facility if the person in question is the subject of an order by a Magistrate to be delivered to police for questioning.

In any case, we recommend contacting a lawyer immediately.

The police can conduct a personal search of you under certain circumstances — for example:

– If they suspect you of possessing a drug of dependence (under the Drugs, Poisons and Controlled Substances Act)

– If they suspect you intend to supply a volatile substance to someone under 18 to inhale or suspect a person under 18 of possesses a volatile substance

– If they have reasonable grounds to suspect you of committing a serious indictable offence.

The police can search your house, boat or vehicle if:

– They have a warrant

– They suspect there is a drug of dependence (no warrant required)

– They suspect you of committing a serious indictable offence or find you committing a serious offence.

If the police plan to or have searched you or your home, please contact us for a free consultation.

You have to go to the police if you are being formally arrested or you are being formally detained for questioning about an indictable offence. You can also be required to go to a police station for a blood/breath test in relation to a drink or drug driving offence.

If the police ask you to go to the station in any other circumstance, you can refuse. However, if you have been asked to go to the police station for any reason, it is always recommended to seek legal advice before going.

We will also advise on any possible penalties, attend the police interview with you, organise bail applications (if you were arrested) and represent you in Court.
