Client’s House Searched by Police and Drugs Seized
Our client faced a daunting situation when their house was searched by the police, resulting in the discovery of a small amount of methamphetamine and two kilograms of cannabis. Even more concerning, the police located a safe containing 100 grams of methamphetamine. The charges against our client were serious and carried significant penalties.
Through meticulous negotiations with the Office of the Director of Public Prosecutions (ODPP), we were able to secure the withdrawal of the methamphetamine located in the safe. This successful negotiation considerably reduced the gravity of the charges our client was facing. Ultimately, our client was sentenced to a Community Corrections Order for 2 years. This outcome allowed our client to avoid imprisonment and provided an opportunity for rehabilitation and community reintegration.
Client’s House Searched by Police; Drugs and Weapon Seized
In a highly complex case, our client’s house was searched by the police, resulting in a staggering 26 separate charges, including possession of 233.5 grams of cocaine, dangerous weapons, and various other illicit and prescribed restricted substances.
We challenged the legality of the search and, through skillful negotiations, were able to secure a plea deal that reduced the charges to half the amount of cocaine and two weapons charges. Our client was subsequently sentenced to a 16-month Intensive Corrections Order, a result that marked a significant victory in light of the initial charges.
Client Charged with Large Commercial Cultivation of Drugs
Our client, who had a prior criminal record, faced a serious charge of large commercial cultivation of cannabis plants. The potential penalties were severe, including the possibility of a lengthy prison sentence.
Through diligent legal work and persuasive submissions, we successfully negotiated a sentence of an Intensive Corrections Order lasting 2 years and 5 months, with the option of home detention. This arrangement allowed our client to continue working and leave their house six days a week, striking a balance between punishment and rehabilitation.

After the police searched a hotel room that our client had recently left, resulting in the discovery of drugs, our client was charged with a total of 11 offences. Through negotiations, we were able to reduce the charges to two small drug possession charges.
Importantly, we also referred to the Mental Health and Cognitive Impairment Forensic Provisions Act 2020 (NSW) to divert our client away from the criminal justice system and into appropriate care and support. What is the DMTA?
The DMTA is an abbreviation of the Drug Misuse and Trafficking Act, which was established in 1985 to legislate against the supply, possession, manufacturing and use of prohibited drugs in NSW. It is the primary legislation for regulating drugs in NSW and includes a comprehensive list of prohibited substances.
What is a drug driving offence?
A drug driving offence applies when the accused is suspected of driving a motor vehicle while under the influence of prohibited drugs. Charges can be made if prohibited drugs are found in the accused’s blood, urine or oral fluid.

When does a drug possession charge turn into a deemed supply charge?
The minimum traffickable amount of each drug varies based on its weight. For example, the minimum traffickable quantity is 3.0 g for amphetamine, 0.75 g for MDMA/ecstasy and 300 g for cannabis leaf.
What are some defences against a deemed supply charge?
To defend a deemed supply charge, the accused must prove on the balance of probabilities that they were in possession of the prohibited substance for reasons other than supply. For example, holding drugs for another party is a common defence against this charge.
However, the prosecution may decide that a deemed supply charge does not apply depending on the circumstances of the case.
What does “Indicia of Supply” mean?
“Indicia of Supply” refers to evidence that suggests the accused was supplying a prohibited substance. Evidence can include:
